Patna High Court

ANJU MAURYAversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court exercised its inherent powers under Section 482(2) of the BNSS and granted bail to the petitioners, noting the compromise between the parties.

Summary

The petitioners, members of the Maurya family, were named in an FIR relating to a complaint (Case No. 909(C)/2025) alleging assault and other offences under various sections of the Bihar Negotiable (BNS) Act. They contended that the complaint stemmed from matrimonial discord and that a compromise had been reached, with a signed compromise petition dated 06-06-2026, and they sought bail. The State opposed the bail application, arguing the seriousness of the offences. The Court observed that the complaint appeared to be filed in the backdrop of a family dispute now settled by compromise, and therefore exercised its inherent powers under Section 482(2) of the BNSS to grant bail. Consequently, the petitioners were directed to be released on bail upon furnishing a bond of Rs. 10,000 with two sureties each.

Issues considered

  • The applicability of bail in a case arising from a family dispute and alleged false complaint
  • Whether the compromise between parties warrants the exercise of inherent powers under Section 482(2) to grant bail
  • The relevance of the offences listed under the BNS Act to the bail decision
