The Court granted bail to the petitioners subject to a bond, sureties and conditions under Section 438(2) CrPC.
Summary
The petitioners, Raushan Kumar Verma and Shyam Sundar, were named in FIR No.310 of 2025 for assaulting an informant and his son with deadly weapons, alleged to violate Sections 109, 115(2), 126(2), 352 and 3(5) of the Bihar Negotiable Substances Act, 2023. They applied for bail, claiming innocence and asserting that the injury to the informant was minor and stemmed from a petty electricity‑line dispute. The prosecution opposed bail, highlighting that Raushan has one prior conviction and Shyam has four prior convictions. The Court, after considering the seriousness of the offences and the antecedents, granted bail on a bond of Rs 10,000 with two sureties, subject to conditions under Section 438(2) of the Code of Criminal Procedure. The order also imposed compliance conditions such as cooperation with the trial, presence in court, and prohibition against tampering with evidence or concealing antecedents.
