Patna High Court

Manoj KumarversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was denied because the petitioner’s ownership of the vehicle containing the seized illicit liquor established sufficient suspicion of involvement.

Summary

The petitioner, Manoj Kumar, sought anticipatory bail after the police recovered 630 litres of illicit liquor from a vehicle registered in his name. The prosecution alleged that the liquor was contraband under section 30(a) of the Bihar Prohibition and Excise Act and that the petitioner, as the vehicle owner, was implicated. The petitioner argued that no incriminating material was found in his personal possession and that his involvement was merely speculative. The State opposed the bail, emphasizing the large quantity of liquor seized from the petitioner’s vehicle. The Court, noting the petitioner’s ownership of the vehicle from which the illicit liquor was recovered, declined to grant anticipatory bail, concluding that ownership alone sufficed to raise a reasonable suspicion of involvement.

Issues considered

  • Whether anticipatory bail can be granted when the accused is the registered owner of a vehicle from which illicit liquor is seized
  • Whether mere ownership of the vehicle constitutes sufficient grounds for suspicion under section 30(a) of the Bihar Prohibition and Excise Act
