Patna High Court

Ranjan Lal Dev @ Guddu Lal Dev @ Ramesh Kumar RanjanversusThe State Of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner subject to conditions, holding that the absence of possession and the precedent of Ram Vinay Yadav v. State of Bihar justify the relief.

Summary

The petitioner, Ranjan Lal Dev, was implicated in a case (Ali Nagar PS Case No. 11 of 2026) for alleged contravention of Section 30(a) of the Bihar Prohibition and Excise Act involving the seizure of 403.2 litres of Nepali liquor. No liquor was found in his conscious possession and he allegedly fled the scene, leading him to seek anticipatory bail. The State opposed the bail, invoking Section 76(2) of the same Act and citing the petitioner’s prior criminal antecedent. The court, relying on the Full Bench judgment in Ram Vinay Yadav v. State of Bihar, held that anticipatory bail could be granted in the absence of direct possession and for the limited purpose of securing the petitioner’s liberty. Accordingly, the court ordered anticipatory bail with a bond of Rs.10,000, two sureties, and several conditions under Section 438(2) of the CrPC.

Issues considered

  • Whether anticipatory bail can be granted under Section 438 CrPC for an offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act when no possession is established.
  • Whether Section 76(2) of the Bihar Prohibition and Excise Act bars the grant of anticipatory bail in the present circumstances.

vehemently opposed the prayer for anticipatory bail of the
