Ramesh KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner with specified conditions.

Summary

Ramesh Kumar was arrested in connection with a theft of a motorcycle, charged under Sections 317(5), 318(4), 338, 336(3) and 340(2) of the Bihar Penal Code. He had been in custody since 17 April 2026 and claimed he was innocent and a victim of false implication. The petitioner’s counsel argued that he had no knowledge of the theft and sought bail. The Patna High Court, after hearing both sides, allowed the bail application, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties and to appear at Kendua Police Station in Jharkhand every Sunday. Failure to comply would lead to cancellation of bail.

Issues considered

  • Whether the petitioner is entitled to bail despite the serious charges under the Bihar Penal Code
