BAIL GRANTED

Holding

The court granted bail to the petitioner with specified conditions.

Summary

Ajit Kumar was arrested in connection with a theft of a motorcycle and charged under multiple sections of the Indian Penal Code (411, 413, 414, 420, 467, 468, 471, 120B/34) and the Arms Act (25(1‑B)a, 26, 35). He has been in custody since 21‑04‑2026 and claims he is innocent, asserting that his name appears only in the confessional statement of a co‑accused. The petitioner’s counsel offered a charitable donation of Rs. 25,000 and sought bail, arguing lack of direct evidence against him. The court examined the nature of the allegations and the petitioner’s willingness to comply with conditions. It allowed the bail application, directing a bond of Rs. 10,000 with two sureties, monthly police‑station attendance, and the stipulated donation. The bail order is subject to cancellation upon default of the conditions.

Issues considered

  • Whether bail should be granted to the accused despite the serious nature of the offences under the IPC and Arms Act
  • Whether the conditions imposed by the court are appropriate and sufficient to ensure the accused’s attendance
