Patna High Court

Md Jalal @ Jalal @ JalaluddinversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted as the quantity of narcotic was small and the petitioner had no criminal antecedent.

Summary

The petitioner, Md Jalal, was arrested for possession of 9.43 grams of smack under Sections 8(c) and 21(b) of the NDPS Act. He filed an application for regular bail, claiming innocence and a clean antecedent, having been in custody since 29‑04‑2026. The State opposed the bail on the ground of the alleged offence. The High Court, noting the small quantity of narcotic involved, allowed the bail application, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties and to comply with conditions of regular attendance at the police station and verification of antecedents. The order was made subject to Section 482(2) of the Criminal Procedure Code and expressly stated that the observations were prima facie and would not affect the trial.

Issues considered

  • Whether bail should be granted in a case of possession of 9.43 gm of narcotic under the NDPS Act.
  • Whether the small quantity of the seized narcotic justifies the grant of bail.
  • Whether the petitioner’s clean antecedent warrants bail despite the charges.
