Patna High Court

Akansha ShekharversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that bail should be granted as the circumstances did not warrant continued detention.

Summary

Akansha Shekhar was arrested in connection with a case alleging that she cheated an informant of Rs. 42,61,000 by using false assurances on WhatsApp and personal meetings. The petitioner contended that the money was voluntarily gifted during a personal relationship and that she was innocent of the offences listed under the Bharatiya Nyaya Sanhita, 2023. The State and the informant opposed the bail, arguing the seriousness of the charges including cheating, extortion and criminal intimidation. The Court examined the material facts and the petitioner’s custody since 17‑04‑2026 and found no compelling reason to deny bail. Consequently, the Court allowed the regular bail application, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties of equal amount. The order was expressly limited to bail considerations and not an adjudication on the merits of the criminal allegations.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious nature of the offences under the Bharatiya Nyaya Sanhita, 2023.

                                       ORAL ORDER

2 24-06-2026 Heard the learned Senior Counsel for the petitioner,

the learned APP for the State and the learned counsel for the

                   informant.

                                 2. The petitioner seeks regular bail in connection with

Chhapra Town P.S. Case No. 305 of 2025 registered for the

                   offence under Section(s) 316(2), 318(4), 338, 336(3), 340(2),

308(2), 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

                                 3. As per the prosecution case, the petitioner is

accused of cheating the informant of Rs. 42,61,000/- after

establishing a relationship with him. The petitioner is alleged to

have extracted a huge amount of money by inducing, alluring

and cheating the informant by giving false assurances through

social media platforms such as WhatsApp as well as through

          personal meetings with the informant.

                       4. Learned Senior Counsel for the petitioner submits

that the petitioner is innocent and has not committed any

offence. It is further submitted that the petitioner is in custody

since 17.04.2026. It is also contended that the petitioner is a

woman and was in a relationship with the informant and while

in relationship, the informant may have voluntarily gifted

money and other articles to her. It is thus argued that the

offences as alleged are not made out.

                       5. Learned A.P.P. for the State and the learned counsel

for the informant have vehemently opposed the prayer for bail.

                       6. Considering the aforesaid facts and circumstances,

this application for regular bail is allowed.

                       7. Accordingly, let the petitioner, above named, be

released on bail on furnishing bail bonds of Rs. 10,000/- (Ten

Thousand) with two sureties of the like amount each to the

satisfaction of the learned Court below where the case is

pending/successor Court in connection with Chhapra Town P.S.

          Case No. 305 of 2025.
