Holding
The court held that regular bail cannot be granted to the petitioner.
Summary
The petitioner, Siyaram Singh, applied for regular bail in a case registered under multiple sections of the Bharatiya Nyaya Sanhita, 2023, relating to an alleged organized cheating racket in Bihar Police recruitment exams. The prosecution alleged that a police raid uncovered six individuals involved in promising candidates government jobs for large sums, and that Singh's seized mobile phone contained incriminating documents. During interrogation, Singh reportedly admitted involvement and identified other associates. The court noted that Singh has been in custody since February 6, 2026 and possesses a prior criminal record, and that prima facie material indicates his participation in the fraud. Considering the gravity of the offences and the organized nature of the alleged crime, the court was not inclined to grant bail. Consequently, the application for regular bail was dismissed. The court clarified that its observations were prima facie and limited to the bail application, without prejudice to the trial.
