Holding

Regular bail was not granted to the petitioner.

Summary

The petitioner, Sanjay Kumar Sah, applied for regular bail in a case involving possession of a country-made pistol, a live cartridge, and 20.22 grams of brown sugar. He was charged under Sections 317(5) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, Sections 25(1‑Ba), 26 and 35 of the Arms Act, and Sections 8(c), 21(b), 21(c) and 22(c) of the NDPS Act. The prosecution presented evidence of the contraband and highlighted the petitioner’s seven prior criminal antecedents, noting his custody since 16‑12‑2025. The court considered the seriousness of the offences, the nature of the seized items, and the petitioner’s criminal history. Concluding that the material facts indicated a prima facie case of involvement, the court declined to grant regular bail and dismissed the application.

Issues considered

  • Whether regular bail should be granted to the petitioner given the seriousness of the offences under the Bharatiya Nyaya Sanhita, Arms Act and NDPS Act.
  • Whether the presence of a firearm, live cartridge and narcotic substance, together with prior criminal antecedents, justifies denial of bail.
