Ajit Kumar RayversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court allowed the bail application, granting regular bail with specified conditions.

Summary

The petitioner, Ajit Kumar Ray, was arrested in connection with the seizure of 69.120 litres of illicit liquor from his residence, alleged under Section 30(a) of the Bihar Prohibition and Excise Act. He had been in custody since 2 May 2026 and possessed a prior criminal antecedent from a 2025 excise case. The petitioner claimed innocence and offered to donate Rs. 25,000 to a charitable organization without admitting guilt, while the State opposed bail. The Court, after considering the facts, the period of custody, and the submissions, granted regular bail subject to a cash deposit, sureties, and attendance conditions. The order emphasized that the observations were prima facie and would not affect the merits of the trial.

Issues considered

  • Whether the petitioner is entitled to regular bail in a case under Section 30(a) of the Bihar Prohibition and Excise Act despite the seizure of a large quantity of illicit liquor and a prior criminal antecedent.
