Holding

The bail application was dismissed, and the petitioner was ordered to remain in custody.

Summary

Vikash Kumar applied for regular bail in a case registered under Section 309(6) of the Bihar Narcotic Substances Act and Section 27 of the Arms Act, alleging that he was falsely implicated based on a co-accused's self‑inculpatory statement. The prosecution alleged that Rs. 46,000 was looted after the accused fired upon an informant, injuring his hand. The petitioner’s counsel highlighted his single prior criminal antecedent and his willingness to cooperate with the trial, while the State opposed bail. The court examined the seriousness of the alleged offences and the allegations against the petitioner. Concluding that the allegations warranted continued custody, the court refused bail and dismissed the application.
