Patna High Court

Ranjit Mistri @ Ranju Lohar @ Ranjeet VishwakarmaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The High Court granted regular bail to the petitioner.

Summary

The petitioner, Ranjit Mistri, was arrested in connection with the recovery of two litres of country-made liquor from his residence and charged under Sections 30(a) and 37 of the Bihar Prohibition and Excise Amendment Act, 2022. He applied for regular bail, claiming innocence despite having three prior criminal antecedents and having been in custody since 8 May 2026. The prosecution opposed the bail, but the High Court, after considering the facts, allowed the bail application. The court ordered the petitioner to furnish a bail bond of Rs.10,000 with two sureties of the same amount and to appear at the police station on the first and third Sundays of each month. Non‑appearance would lead to cancellation of the bail, and the court advised the Special Excise Judge not to refer similar cases to the High Court.

Issues considered

  • Whether regular bail should be granted to a person accused under Sections 30(a) and 37 of the Bihar Prohibition and Excise Amendment Act, 2022.
  • Whether the bail bond and conditions imposed are appropriate given the petitioner’s antecedents and the nature of the offence.
