Binod RaiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court allowed the petition for regular bail, imposing specific conditions and a cash bond.

Summary

The petitioner, Binod Rai, was arrested in connection with the recovery of 129.600 litres of illicit liquor and charged under Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act, 2022. He applied for regular bail, asserting his innocence, clean antecedents, and offering to donate Rs. 25,000 to a charitable organization without admitting guilt. The State opposed the bail. The Court, after considering the circumstances, granted regular bail subject to a cash bond of Rs. 10,000 with two sureties and several conditions, including the charitable donation, monthly attendance at the police station, and verification of antecedents, all under Section 482(2) of the B.N.S.S. The order emphasized that its observations were prima facie and not to influence the trial. Consequently, the petitioner was released on bail with the stipulated conditions.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious nature of the alleged offence under the Bihar Prohibition and Excise Act.
  • Whether the conditions imposed by the Court, including the charitable donation and monthly police attendance, are permissible under Section 482(2) of the B.N.S.S.
