Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to specified conditions.

Summary

Petitioner Praveen Kumar was arrested on 15 March 2026 in connection with Excise P.S. Case No. 123, alleged to involve the recovery of 838.080 litres of illegal foreign liquor. He filed a bail petition, contending that the seizure was made from the vehicle and not from his personal possession, and that procedural requirements under Sections 103 and 105 of the BNSS, 2023 were not complied with. The prosecution opposed bail, stating that the petitioner was apprehended at the scene and has two other pending cases, though he is already on bail in those matters. The Court examined the facts, the nature of the offence under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act, and the petitioner’s antecedents. It granted bail on a bond of Rs.10,000 with two sureties, imposing conditions of cooperation, physical presence, non‑tampering with evidence, and verification of criminal antecedents.

Issues considered

  • The petitioner’s eligibility for bail in offences under the Bihar Prohibition and Excise Act.
  • Whether non‑compliance with Sections 103 and 105 of the BNSS, 2023 affects bail eligibility.
  • The impact of the petitioner’s prior criminal antecedents on the bail decision.
