Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner on a bond of Rs. 10,000 with conditions.

Summary

The petitioner, Shubham Kumar, was arrested on 28 April 2026 in connection with an assault and theft incident reported on 22 April 2026, alleged under Section 309(4) of the Bharatiya Nyaya Sanhita, 2023. The prosecution’s case is based on an informant’s report and a self‑confessional statement recorded on 27 April 2026, with a motorcycle allegedly recovered from a co‑accused’s house. The petitioner contended that he has a clean antecedent, was initially not named in the FIR, and that no material has been recovered from his possession, arguing that his implication is false. The Additional Public Prosecutor opposed bail, citing the confessional statement and the recovered motorcycle. The Court, noting the petitioner’s clean record and lack of concrete evidence against him, granted bail on a bond of Rs. 10,000 with two sureties, subject to conditions of cooperation, presence in court, and non‑tampering with evidence or witnesses. The bail order also directed that verification of antecedent should not delay the acceptance of the bond.

Issues considered

  • Whether the petitioner is entitled to bail under Section 309(4) of the Bharatiya Nyaya Sanhita, 2023.
  • Whether the self‑confessional statement and recovery of a motorcycle from a co‑accused justify denial of bail.
  • Whether the petitioner’s clean criminal antecedent warrants the grant of bail.
