Patna High Court

Viccky YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner, subject to the conditions of Section 438(2) CrPC and Section 482(2) BNSS.

Summary

The petitioner, Viccky Yadav, was named in an FIR under Section 30(a) of the Bihar Prohibition and Excise Act for alleged illegal manufacture and trade of illicit liquor, with 200 litres recovered from a vehicle not directly linked to him. The petitioner sought anticipatory bail, arguing that the liquor was not in his conscious possession and that the accusation stemmed solely from a co-accused’s disclosure. The Additional Public Prosecutor opposed the bail, citing the petitioner’s involvement in five similar cases and his bail status in those matters. The court examined the prima facie evidence and noted the lack of direct possession by the petitioner. Consequently, the court directed that the petitioner be released on anticipatory bail upon furnishing a bail bond of Rs.10,000 with two sureties, subject to conditions under Section 438(2) of the CrPC and Section 482(2) of the BNSS.

Issues considered

  • Whether anticipatory bail can be granted when the alleged illicit liquor was not in the petitioner’s physical possession.
  • Whether the petitioner’s alleged involvement under Section 30(a) of the Bihar Prohibition and Excise Act justifies denial of bail.
  • Whether the petitioner’s prior criminal cases and bail status affect the grant of anticipatory bail.
