Patna High Court

Rajesh Kumar RaiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioners subject to a bond and specified conditions.

Summary

Petitioners Rajesh Kumar Rai and Prabhat Kumar Dubey were arrested on 23 May 2026 in connection with a case under Section 30(a) of the Bihar Prohibition & Excise Act after police recovered 19.5 litres of illicit liquor from a scooty and a backpack. The petitioners contended that they were falsely implicated, that the scooty belonged to another person, and that the seizure was conducted without compliance with Sections 103 and 105 of the Bihar Narcotic and Smuggling (BNSS) Act, 2023. The State opposed bail, citing the recovery of liquor from the petitioners' possession and an antecedent case, though the petitioners were already on bail in that matter. The Court examined the factual matrix, the alleged procedural lapses, and the relevance of the antecedent, and decided to grant bail on a bond of Rs.10,000 with two sureties and several conditions. The order also directed verification of the petitioners' criminal antecedents but stipulated that bail should not be delayed for that purpose.

Issues considered

  • Whether the petitioners are entitled to bail despite the seizure of liquor allegedly recovered from their possession.
  • Whether non‑compliance with Sections 103 and 105 of the BNSS Act, 2023, warrants denial of bail.
  • Whether the ownership of the scooty and the presence of an antecedent case affect the bail decision.
