Patna High Court

Sangita DeviversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to a bond of Rs.10,000 and specified conditions.

Summary

Sangita Devi was arrested on 18 May 2026 in connection with a case alleging violation of Section 30(a) of the Bihar Prohibition and Excise Act for the seizure of 450 litres of Nepali Saufi liquor. The petitioner claimed she had no prior criminal record and that the liquor was recovered from the place of occurrence, not from her possession. She also argued that the seizure was conducted by Bihar Home Guard personnel without complying with Sections 103 and 105 of the BNSS, 2023. The State opposed bail, but the court noted the petitioner’s clean antecedent and the procedural lapses, and consequently ordered her release on bail with a bond of Rs.10,000 and two sureties, subject to conditions regarding cooperation, non‑tampering with evidence, and verification of antecedents. The bail order was made without delay for verification purposes.

Issues considered

  • Whether bail should be granted to the petitioner despite the alleged violation of Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the alleged non‑compliance with Sections 103 and 105 of the BNSS, 2023, warrants bail.
  • Whether the petitioner’s claim of no possession and clean antecedent affects the bail decision.
