Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was refused.

Summary

The petitioners, four relatives, filed an anticipatory bail application fearing arrest in a case where they are accused of murder of an informant’s daughter over dowry demands. The prosecution’s FIR charges them under multiple IPC sections including murder, dowry death, and related offences, as well as under Section 4 of the Dowry Prohibition Act. The petitioners contended they are innocent, have clean antecedents, and are being over‑implicated merely because of family ties to the deceased. The State opposed bail, emphasizing the specific allegations of dowry demand and homicide. Considering the seriousness of the accusations and the nature of the offences, the Court refused the anticipatory bail.

CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH
                                       ORAL ORDER

7 08-01-2026 Heard learned counsel for the petitioners and the

                   State.

                                 2. Petitioners apprehend arrest in a case registered for

                   the offences punishable under Sections 323, 324, 326, 341, 504,

506, 498A, 304B, 34 of the Indian Penal Code and Section 4 of

                   the Dowry Prohibition Act.

                                 3. As per prosecution case, all the F.I.R. named

accused persons, including this petitioner, committed murder of

the daughter of informant due to non-fulfillment of demand of

                   dowry.
Patna High Court CR. MISC. No.40946 of 2025(7) dt.08-01-2026
                                                          2/2

                                     4. Learned counsel for the petitioners submits that

petitioners are innocent and have committed no offence.

Petitioners are simply victims of over-implications merely

because they are family members of the deceased. Petitioners

are separate in mess and property. Thrust of accusation is

against husband of the informant. Petitioners claim clean

                        antecedent.

                                     5. Learned A.P.P. for the State vehemently opposed

the bail application and submitted that petitioners are named in

the F.I.R. with specific accusation that they demanded dowry

and committed murder of the deceased.

                                     6. Considering the nature of accusation and gravity of

the offence, prayer for anticipatory bail of the petitioners is

                        refused.
