Pappu @ Majid @ Mohammad MajidversusThe State of Bihar

Decided

BAIL REJECTED

Holding

Anticipatory bail was denied as the seriousness of the offences and the petitioner’s criminal antecedents warranted denial.

Summary

The petitioner, Pappu @ Majid @ Mohammad Majid, sought anticipatory bail after police, acting on secret information, raided a hotel and apprehended members of an online fraud gang who named him as an associate. The prosecution alleged that the petitioner was involved in offences punishable under IPC sections 420, 467, 468, 471, 120B and 34, as well as IT Act sections 66(c) and 66(d). The petitioner also has eight prior criminal convictions, which the court considered in evaluating the bail application. The court examined whether the seriousness of the alleged offences and the petitioner’s antecedents justified granting anticipatory bail. Concluding that the nature of the accusations and the petitioner’s criminal record warranted denial, the court rejected the anticipatory bail petition.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner given the serious nature of the alleged offences under the IPC and IT Act
  • Whether the petitioner’s prior criminal antecedents preclude the grant of anticipatory bail
