Patna High Court

Rohit Kumar ChoudharyversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted as the recovery of illicit liquor could not be linked to the petitioner's conscious possession.

Summary

The petitioner, Rohit Kumar Choudhary, was named in an FIR for alleged illegal manufacturing and trading of illicit liquor under Section 30(a) of the Bihar Prohibition and Excise Act, with 195.12 litres of liquor recovered. He contended that the liquor was seized from a tempo he owned, which is a public carrier, and that he had no conscious physical possession of the contraband. The prosecution opposed bail, arguing the seriousness of the offence. The court examined whether the recovery could be attributed to the petitioner’s possession and found that it could not be established prima facie. Consequently, the court directed that the petitioner be released on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to the conditions of Section 438(2) of the Cr.P.C. and Section 482(2) of the BNSS Act.

Issues considered

  • Whether the petitioner was in conscious physical possession of the illicit liquor recovered.
  • Whether bail under Section 438(2) of the Criminal Procedure Code is warranted in the circumstances.
  • Whether the provisions of Section 30(a) of the Bihar Prohibition and Excise Act justify denial of bail.
