Patna High Court

Md Sadim SheikhversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner, subject to bond and surety conditions.

Summary

The petitioner, Md Sadim Sheikh, was arrested in connection with a kidnapping case (PS Madhwapur Case No. 68 of 2024) alleging the abduction of a 17‑year‑old girl for illicit intercourse or marriage. The petitioner sought anticipatory bail, contending that the alleged victim voluntarily left her parental home, married him under Muslim rites, and was pregnant, with no signs of violence as per a medical report. The victim’s statement recorded under Section 183 of the Bhartiya Nagarik Suraksha Sanhita (B.N.S.S.) denied any kidnapping and affirmed the marriage was of her own free will. The State opposed the bail, citing offences under Sections 363, 366(A), and 34 of the Indian Penal Code. The court, noting the victim’s unequivocal statement and lack of evidence of coercion, granted anticipatory bail subject to a bond and sureties, invoking Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S.

Issues considered

  • Whether anticipatory bail should be granted in a case alleging kidnapping and sexual assault of a minor.
  • Whether the victim’s voluntary statement under Section 183 B.N.S.S. negates the alleged offences under IPC Sections 363, 366(A), and 34.
  • Applicability of Section 438 Cr.P.C. and Section 482 B.N.S.S. in granting bail.

                             4. Learned counsel appearing on behalf of the petitioner

submitted that the sister of the informant was in love affairs with

                   5. It is submitted that the sister of the informant, left her

parental home on her own. In support of submission, learned
