Patna High Court

Pravesh Yadav @ Pravesh Kumar YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The application for regular bail was allowed.

Summary

The petitioner, Pravesh Yadav, was arrested in connection with offences under Sections 25(1‑B)a, 26 and 35 of the Arms Act after a pistol and cartridges were recovered from co‑accused Raja Kuraishi. The petitioner claimed he was falsely implicated, asserted his innocence, and noted that he had three prior criminal antecedents and had been in custody since 14‑04‑2026. He applied for regular bail, undertaking to cooperate with the investigation. The Additional Public Prosecutor opposed the bail, but the Court, after considering the facts and circumstances, granted regular bail on a bond of Rs.10,000 with two sureties. The bail was conditioned on the petitioner reporting every Sunday to Vashishth Nagar Police Station in Jharkhand and on automatic cancellation if he becomes involved in any fresh case.

Issues considered

  • Whether regular bail can be granted to an accused of offences under the Arms Act (Sections 25(1‑B)a, 26, 35).
  • Whether the petitioner’s prior criminal antecedents preclude the grant of bail.
  • What conditions may be imposed on bail in such a case.
