Patna High Court

Abhishek Ranjan @ Abhishek KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner with specified conditions.

Summary

The petitioner, Abhishek Ranjan, was arrested in connection with the recovery of 92.58 litres of illicit liquor alleged under Section 30(a) of the Bihar Prohibition and Excise Act, 2022. He applied for regular bail, asserting innocence, a clean antecedent, and offered to donate Rs. 25,000 to a charitable organization without admitting guilt. The State opposed the bail. The High Court, after considering the facts, allowed the bail application, directing release on a bail bond of Rs. 10,000 with two sureties, subject to conditions including the charitable donation, monthly attendance at the police station, and verification of antecedents. The order emphasized that the observations were prima facie and not to influence the trial. The bail was granted under the inherent powers of the court under Section 482(2) of the Criminal Procedure Code.

Issues considered

  • Whether the petitioner is entitled to regular bail for an offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2022.
  • Whether the conditions imposed, including a charitable donation, are permissible under law.
  • Whether the court can exercise its inherent powers under Section 482(2) of the CrPC to grant bail in this case.
