Patna High Court

Ranjit PaswanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court allowed the bail application, granting regular bail subject to specified conditions.

Summary

The petitioner, Ranjit Paswan, was arrested in connection with the seizure of about 100 litres of illicit country-made liquor from a motorcycle, alleged to be a violation of section 30(a) of the Bihar Prohibition & Excise Act. He contended that he was not arrested at the place of occurrence, was not the owner of the motorcycle, and has a clean antecedent. He offered to donate Rs.25,000 to a charitable organization without admitting guilt. The State opposed bail. The High Court, after considering the facts and submissions, granted regular bail on a bond of Rs.10,000 with two sureties, conditioned on the donation, verification of clean antecedent, and regular attendance at the police station. The order expressly limited its observations to the bail application and did not prejudice the merits of the trial.

Issues considered

  • What is the appropriateness of granting bail to a person accused under section 30(a) of the Bihar Prohibition & Excise Act, considering the circumstances of arrest, ownership of the vehicle, and clean antecedent?
