Patna High Court

Avinash KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner subject to specified conditions.

Summary

The petitioner, Avinash Kumar, was the driver of an ambulance from which about 190 litres of illicit liquor was recovered, leading to charges under sections 30(a), 41 and 56(b) of the Bihar Prohibition & Excise Act. He applied for regular bail, claiming a clean antecedent and asserting that he had no involvement with the liquor. The State opposed the bail, but the court, after considering the facts and the petitioner's willingness to donate Rs.25,000 to a charitable organization, granted bail. The court ordered a bail bond of Rs.10,000 with two sureties, a deposit of Rs.25,000 to Ramakrishna Mission Ashrama, verification of his clean antecedent, and mandatory attendance at the police station on specified days. The order is limited to the bail application and does not prejudice the merits of the trial.
