Holding

The bail application was dismissed, and the petitioner was not granted bail.

Summary

The Patna High Court considered a bail application filed by Sonu Kumar, who was arrested in connection with a cyber fraud case (Nalanda P.S. Case No. 90/2026) involving alleged deception in the sale of cement at below‑market rates. The prosecution alleged that the petitioner, along with co‑accused, violated Sections 318(4), 319(2), 336(3), 340(2) of the B.N.S. and Section 66D of the Information Technology Act. The petitioner’s counsel argued that he was falsely implicated, had no prior criminal record, and had been in custody since 10‑April‑2026, offering to cooperate with the trial. The State opposed the bail, emphasizing the seriousness of the cyber‑fraud allegations. The Court, noting the nature of the alleged cyber fraud, declined to grant bail and dismissed the application.

Issues considered

  • Whether bail should be granted to the petitioner in a cyber fraud case under Sections 318(4), 319(2), 336(3), 340(2) of the B.N.S. and Section 66D of the IT Act.
