Holding

The bail application was dismissed, and the petitioner was not granted regular bail.

Summary

The Patna High Court considered a bail application filed by Niranjan Sharma, who was arrested in connection with a cyber fraud case (PS Case No. 56/2026) involving offences under Sections 115(2), 117(2), 318(4), 132, 111, 3(5) of the B.N.S. and Section 66D of the Information Technology Act. The prosecution alleged that the petitioner was a member of a cyber fraud gang and had cheated an informant. The petitioner’s counsel argued that he was falsely implicated, has a clean antecedent, has been in custody since 16‑02‑2026, and is willing to cooperate with the trial. The State opposed the bail, emphasizing the seriousness of the cyber‑fraud allegations. The Court, noting the nature of the alleged offences, declined to grant regular bail and dismissed the application.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being accused of cyber fraud offences under the B.N.S. and the IT Act
  • Whether the seriousness of the alleged cyber‑fraud offences justifies denial of bail
