Patna High Court

Lavkush Kumar @ Ravish KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner subject to a cash bond, sureties and a condition of cooperation with the trial.

Summary

The petitioner, Lavkush Kumar, was arrested in connection with offences under Sections 103(1) and 3(5) of the Bihar Narcotic Substances Act and Section 27 of the Arms Act. The prosecution alleged that Bhuneshwar Prasad was the assailant, while the petitioner claimed he was falsely implicated, had a clean record, and had been in custody since 08‑06‑2025. The petitioner’s counsel sought regular bail, undertaking to cooperate with the trial, whereas the Additional Public Prosecutor opposed the bail. The High Court, after considering the facts, allowed the regular bail application, directing the petitioner to furnish a bail bond of Rs.10,000 with two sureties and to appear in court as required. Non‑compliance with the cooperation condition would lead to cancellation of the bail.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious nature of the charges under the Bihar Narcotic Substances Act and the Arms Act.
  • Whether the conditions imposed by the court are sufficient to ensure the petitioner’s cooperation with the trial.
