The court granted bail to the petitioner.
Summary
Sweeti Kumari was arrested in connection with a case under Sections 25(1‑b)a, 26 and 35 of the Arms Act, alleged to have withdrawn Rs. 2,90,000 to aid her lover Sagar Kumar, who is said to have fired at her husband. She filed a bail application, claiming innocence and that she was implicated only on suspicion, and highlighted her status as a woman. The State opposed the bail. The Patna High Court, noting that the alleged shooting was directed at the co‑accused and considering the petitioner’s gender, allowed the bail application, directing release on a Rs.10,000 bond with two sureties. The order was limited to bail and did not express any view on the merits of the criminal case.
Issues considered
- Whether bail should be granted to the petitioner under the Arms Act offences.
- Whether the petitioner’s gender and the nature of the allegations justify granting bail.
