Patna High Court

Md. Akhtar @ Md. Akhtar AliversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner, subject to a bond and conditions, recognizing his right to bail in the circumstances.

Summary

The petitioner, Md. Akhtar, was implicated in a FIR alleging that he, along with two others, fired at an informant and threatened him via mobile, in a dispute over agricultural land. He faced charges under Sections 190, 191(2), 191(3), 308(5), 351(2), 351(3) and 352 of the Bharatiya Nyaya Sanhita, 2023. The petitioner pleaded innocence, arguing the case stemmed from a land conflict and that two co‑accused had already been granted anticipatory bail. The State opposed bail, but the court noted the similarity of the allegations to those of the co‑accused and the petitioner’s right to bail. Consequently, the court ordered his release on bail upon furnishing a bond of Rs.30,000 and compliance with conditions under Section 482(2) of the B.N.S.S., 2023.

Issues considered

  • Whether the petitioner is entitled to bail/anticipatory bail despite the serious charges under the B.N.S.S.
  • Whether the grant of anticipatory bail to co‑accused influences the bail decision for the petitioner
