Patna High Court

Uday Narayan Singh @ Uday Nr. SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to both petitioners, subject to a bail bond of Rs.10,000 and two sureties each.

Summary

The petitioners, Uday Narayan Singh and Muni Sah, applied for anticipatory bail fearing arrest in a complaint (Purnea Case No. 2007 of 2019) alleging offences under sections 406, 420, 467, 468, 120B and 34 of the Indian Penal Code. The prosecution alleged that the petitioners executed a sale deed fraudulently in favour of co‑accused, thereby cheating the complainant. The petitioners contended that they were falsely implicated in what is essentially a civil land dispute and produced title documents to show ownership, also emphasizing their clean criminal record. The State opposed the bail. After hearing both sides, the Court noted the nature of the allegations, the lack of any criminal antecedent and the civil character of the dispute, and ordered that both petitioners be released on anticipatory bail upon furnishing a bail bond of Rs.10,000 with two sureties each, subject to surrender within four weeks.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners in a case involving alleged fraud, criminal breach of trust and conspiracy under the IPC
  • Whether the allegations constitute a criminal offence or merely a civil dispute
  • Whether the petitioners' clean criminal record warrants bail
