Patna High Court

Aakash KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted as the petitioner has a clean antecedent, is not the owner of the vehicle, and the prosecution failed to comply with Sections 103 and 105 of the BNSS.

Summary

Aakash Kumar was arrested on 16 May 2026 for alleged contravention of Section 30(a) of the Bihar Prohibition and Excise Act, 2018 after 450 litres of country‑made Mahua liquor were seized from a tempo. The petitioner claimed he had a clean antecedent, was falsely implicated, and that the liquor was not in his conscious possession nor was he the owner of the tempo. He also contended that the seizure violated Sections 103 and 105 of the BNSS because the seizure list witnesses were police personnel. The Additional Public Prosecutor opposed bail. Considering the clean antecedent, lack of ownership of the vehicle, and alleged procedural lapses, the court granted bail on a bond of Rs 10,000 with two sureties and imposed conditions for cooperation, appearance, and non‑tampering with evidence.

Issues considered

  • Whether bail should be granted to the petitioner under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.
  • Whether the seizure complied with Sections 103 and 105 of the BNSS.
  • Whether the petitioner’s ownership of the tempo from which the liquor was seized is a factor for bail.
