Patna High Court

Kanhaiya Kumar YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to monetary sureties and conditions prescribed under Section 480(3) of the B.N.S.S.

Summary

The petitioner, Kanhaiya Kumar Yadav, was arrested in connection with a case registered under Sections 25(1‑b)a and 26 of the Arms Act and Section 20(b)(ii)(B) of the NDPS Act after a seizure allegedly yielded 257 g of a cannabis‑like substance and a country‑made katta loaded with a live cartridge. The petitioner contended that he was falsely implicated, that no incriminating material was recovered from his person, and that his arrest was based merely on suspicion and his prior criminal record. The State argued that the petitioner is a habitual offender and faces serious charges. The court examined the charge‑sheet, the period of custody since 08‑08‑2025, and the seriousness of the offences, and concluded that bail could be granted with appropriate safeguards. Accordingly, the court ordered his release on bail upon furnishing a Rs 10,000 bond with two sureties and imposed conditions under Section 480(3) of the B.N.S.S., including personal surety and attendance requirements.

Issues considered

  • What is the appropriateness of granting bail to a person accused of offences under the Arms Act and NDPS Act, considering the seriousness of the offences and the petitioner’s antecedents?
  • Whether the seizure of contraband and the alleged possession constitute sufficient grounds to deny bail in the absence of direct recovery from the petitioner.
