Patna High Court

Himanshu @ Goldi @ Himanshu Kr. SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petitioner shall be released on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to specified conditions.

Summary

The petitioner, Himanshu Kr. Singh, was arrested on 9 May 2026 in connection with the seizure of 360 litres of spirit alleged to belong to him under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. He contended that he was not present at the scene and that his name was only disclosed by co‑accused persons who have since been granted bail. The State opposed bail, citing a similar pending case against the petitioner. The Court examined whether the testimony of co‑accused alone sufficed to deny bail and considered the petitioner’s criminal antecedent. It held that bail could be granted on a bond of Rs.10,000 with two sureties, subject to conditions of cooperation, presence in court, and no tampering with evidence. Accordingly, the petitioner was ordered to be released on bail.

Issues considered

  • Whether the petitioner is entitled to bail despite the allegation that the seized spirit belongs to him based solely on co‑accused statements.
  • Whether the existence of another pending case of similar nature bars the grant of bail.
  • Whether bail can be granted under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
