Patna High Court

Lalu Mahto @ Shailendra Mahto @ Shailendra Kumar SahuklaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to bond and conditions.

Summary

The petitioner, Lalu Mahto, was arrested on 9 April 2026 in connection with a case involving the seizure of 301.26 litres of foreign liquor and charged under IPC sections 272, 273, 34 and the Bihar Prohibition and Excise Act, 2018 sections 41(1)(2), 47 and 30(a). He contended that his name was implicated solely on the basis of a statement by a co‑accused, Vishal Kapoor, and that no material was recovered from his possession. The petitioner also argued that the seizure list was prepared by police officers, violating mandatory provisions of Sections 103 and 105 of the Bihar Narcotic Substances (BNSS) Act, 2023. The State opposed bail, highlighting six prior criminal cases against the petitioner, four of which were already on bail. The Court, noting the lack of direct evidence against the petitioner and the reliance on co‑accused testimony, granted bail on a bond of Rs.10,000 with two sureties, subject to conditions of cooperation, presence in court, and non‑tampering with evidence. The order also directed verification of the petitioner’s criminal antecedent without delaying the acceptance of bail.

Issues considered

  • Whether bail should be granted when the accusation is based solely on a co‑accused's statement and no material is recovered from the petitioner
  • Whether the alleged non‑compliance with Sections 103 and 105 of the BNSS Act, 2023, affects the bail decision
  • Impact of the petitioner’s prior criminal cases on the grant of bail
