Patna High Court

Binod yadav @ Ramashakar YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner as the recovery did not prima facie establish his personal possession of illicit liquor.

Summary

The petitioner, Binod Yadav, was named in an FIR for alleged illegal manufacture and trade of illicit liquor, with 86.4 litres recovered from a vehicle, but not from his personal possession. He sought anticipatory bail, arguing that the recovery was based solely on statements of co-accused and that he had no direct possession of the liquor. The Additional Public Prosecutor opposed the bail. The court examined the factual submissions and noted that the prima facie evidence did not show the petitioner’s physical possession of the illicit liquor. Consequently, the court directed that the petitioner be released on bail upon surrendering within four weeks, subject to a bail bond and sureties, and conditions under Section 438(2) of the CrPC and Section 482(2) of the BNSS. The bail was granted pending further trial.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 of the CrPC in view of the alleged recovery of illicit liquor.
  • Whether the recovery of liquor from a vehicle, without the petitioner's personal possession, suffices to deny bail.
