Patna High Court

Aisha KhatoonversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that, given the petitioner’s clean antecedent and the bail granted to co‑accused, regular bail may be granted subject to prescribed conditions.

Summary

Aisha Khatoon, the mother‑in‑law of the deceased, was charged with multiple offences including assault, attempt to murder, dowry death and murder under the Indian Penal Code. She had been in custody since July 2025 and claimed innocence, asserting a clean antecedent and noting that co‑accused had already been granted bail. The State opposed her regular bail application. The High Court, after considering the circumstances, allowed the bail application, directing her release on a bail bond of Rs.10,000 with two sureties and imposing conditions of personal appearance until framing of charge and regular participation thereafter. Non‑cooperation would lead to cancellation of bail.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being charged with serious offences including murder and dowry death.
