Patna High Court

Geeta DeviversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was refused.

Summary

Geeta Devi, the owner of a motorcycle from which 3.48 litres of illicit liquor was seized, was charged under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. She applied for anticipatory bail, arguing that no incriminating material was found in her personal possession and that she was implicated only on suspicion. The State opposed the bail, highlighting her prior criminal antecedent of a similar nature. The Court considered her ownership of the seized vehicle and the prior record. Finding that the circumstances did not justify anticipatory bail, the Court refused the relief sought.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner who is the registered owner of the vehicle from which illicit liquor was recovered and has a prior similar criminal antecedent.
