Patna High Court

Amit KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The application for regular bail is allowed.

Summary

The petitioner, Amit Kumar, was arrested in connection with a kidnapping and ransom case (Bahadurpur P.S. Case No. 330 of 2025) under Sections 140(2), 140(3) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. He had been in custody since 10 October 2025 and claimed innocence, contending that his co‑accused had already been granted regular bail by a coordinate bench. The State opposed his bail application. The Court examined the facts, the nature of the offences, the petitioner’s custody period, and the precedent of bail granted to the co‑accused. Finding no compelling reason to deny bail, the Court allowed the regular bail application, directing release upon furnishing a bail bond of Rs. 10,000 with two sureties of equal amount.

Issues considered

  • What is the applicability of regular bail under Sections 140(2), 140(3) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 to the petitioner?
  • Whether the petitioner’s continued custody and the grant of bail to the co‑accused justify denial of bail?
