Patna High Court

Ramchandra Yadav @ Ram Chandra Kumar YadavversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The Court held that regular bail could not be granted because of the grave nature of the offences and the prima facie material indicating the petitioner's involvement.

Summary

Ramchandra Yadav was arrested in connection with a murder case (Maheshkhunt P.S. Case No. 124 of 2025) involving offences under Sections 103(1), 238, 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act. The prosecution alleged that he participated in the abduction, assault and killing of the deceased, and a co‑accused’s self‑inculpatory statement implicated him. The petitioner applied for regular bail, claiming he had been in custody since 5 December 2025. The Court examined the seriousness of the charges, the existence of prima facie material linking the petitioner to the crime, and the gravity of the offence. Concluding that the allegations were grave and the evidence sufficient to warrant continued detention, the Court refused to grant bail. The bail application was therefore dismissed, with the Court noting that its observations were limited to the bail matter and would not affect the trial.

                                2. The petitioner seeks regular bail in connection with

Maheshkhunt P.S. Case No. 124 of 2025 registered for the

Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.

                                3. As per the prosecution case, the accused persons,

including the petitioner, allegedly took the deceased away and

thereafter brutally assaulted and killed him causing injuries on

                   various parts of his body.

                                4. The petitioner is in custody since 05.12.2025.

participated in the commission of the offence and had actively

                      assaulted the deceased.

                                    5. The allegations against the petitioner are serious

and grave in nature. There exists prima facie material against

the petitioner indicating his involvement in the commission of

                      the offence.

                                    6. Considering the nature and the gravity of the

offence, this Court is not inclined to grant regular bail to the

                      petitioner.

                                    7. Accordingly, this application for regular bail stands

                      dismissed.

                                    8. It is made clear that any observation made herein is

prima facie in nature and limited solely for the purpose of

adjudication of the present bail application. Such observations

shall not be construed as an expression on the merits of the case

and shall not influence the trial or any other proceedings in any

                      manner.
