Patna High Court

Sikandar Kumar Bin @ Sikandar BinversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

Anticipatory bail was denied to the petitioner.

Summary

The petitioner, Sikandar Kumar, sought anticipatory bail after the police recovered 216 litres of illicit liquor from a seized vehicle and identified him as a co-accused based on a statement by another arrested individual. He contended that he was neither the owner nor the driver of the vehicle and that no incriminating material was found in his possession. The State opposed the bail, highlighting the large quantity of liquor seized and the petitioner's five prior convictions for similar offences. The court examined the seriousness of the alleged offence under Section 30(a) of the Bihar Prohibition and Excise Act and the petitioner’s criminal history. Considering these factors, the court concluded that granting anticipatory bail was inappropriate. Consequently, the petition for anticipatory bail was rejected.
