Jaydeep KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The bail application was allowed, granting the petitioner release on bail with specified conditions.

Summary

The petitioner, Jaydeep Kumar, was arrested in connection with a case involving the seizure of 396 litres of illicit liquor, alleged to be a violation of Section 30(a) of the Bihar Prohibition and Excise Act. He filed an application for regular bail, claiming innocence and offering to donate Rs. 25,000 to a charitable organization without admitting guilt. The State opposed the bail. After considering the custody period, the nature of the offence, and the submissions, the court allowed the bail application, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties and to deposit Rs. 25,000 with Ramakrishna Math, subject to verification. Additional conditions required the petitioner to attend the police station every Sunday of each month, with default leading to cancellation of bail. The court clarified that its observations were prima facie and not a determination on the merits of the case.
