DISMISSED

Holding

Anticipatory bail was denied.

Summary

The petitioner, Deepak Kumar Singh, applied for anticipatory bail fearing arrest in a Piro police case (No. 417 of 2023) involving alleged extortion under IPC sections 386, 387, 504, 506/34. The prosecution alleges that the petitioner demanded ransom, while his counsel argues that the mobile used for the demand does not belong to him and that the parties have settled their dispute. The court examined the direct allegation of extortion against the petitioner. Considering the seriousness of the charge and the lack of a convincing defense, the court was not inclined to grant anticipatory bail. Consequently, the application for anticipatory bail was dismissed, and the petitioner was ordered to surrender within four weeks and apply for regular bail, failing which the police may arrest him.
