DISMISSED

Holding

Regular bail was not granted to the petitioner.

Summary

The petitioner, Sindho Koda, was named in an FIR for alleged involvement in Naxalite activities and for offences under the Arms Act and the Unlawful Activities (Prevention) Act. A co‑accused, arrested at the scene, identified the petitioner as an associate. A search of the co‑accused’s premises yielded a double‑barreled firearm, live cartridges, ammunition, and Naxalite pamphlets. The petitioner has been in custody since 9 July 2025 and is described as an absconder. The court examined the seriousness of the charges, the risk of tampering with evidence, and the petitioner’s status as an absconder, and consequently declined to grant regular bail. The application for regular bail was therefore rejected.

Issues considered

  • Whether regular bail can be granted to an accused of offences under Sections 25(1‑b)a, 26(i)(ii) and 35 of the Arms Act and Sections 18, 20, 22 and 23 of the UAPA, considering the seriousness of the offences and the petitioner’s status as an absconder.
