Holding
The Court granted bail to the petitioner with specified conditions.
Summary
The petitioner, Ravi Ranjan Kumar, was arrested under Sections 25(1‑B)(a), 26 and 35 of the Arms Act after a police raid recovered a weapon and a co‑accused, Sunny Kumar, alleged that the petitioner had supplied the weapon for Rs 36,000. The petitioner contended that he was innocent, that no weapon was recovered from his possession, and that the only incriminating material was Sunny Kumar’s confessional statement. He also highlighted that he had been in judicial custody since 8 April 2026 and that he had no other evidence against him. The State opposed bail, citing ten prior similar offences in the petitioner’s record. After hearing both sides, the Court granted bail with conditions including cooperation with the trial, regular attendance at the police station, and a bail bond of Rs 10,000 with two sureties.
Issues considered
- Whether bail should be granted to the petitioner under the Arms Act offenses despite the allegation in a co‑accused’s confessional statement.
- Whether the petitioner’s prior criminal antecedent justifies denial of bail.
- Whether the absence of a weapon recovered from the petitioner’s possession warrants release on bail.
