Patna High Court

Saroj Kumar Ojha @ Saroj OjhaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court denied bail to Sunil Kumar Tiwari but granted bail to Saroj Kumar Ojha with conditions.

Summary

The High Court heard two bail applications together arising from the same police station case No.295/2024. The petitioners, Saroj Kumar Ojha and Sunil Kumar Tiwari, were charged under several sections of the B.N.S. and Section 27 of the Arms Act for allegedly coming armed, with Sunil specifically accused of firing at the informant's son, causing his death. The prosecution opposed bail for Sunil, citing direct evidence of firing and four firearm injuries in the post‑mortem report, while arguing that Saroj faced only an allegation of being armed and threatening, with no charge of firing. The Court noted that co‑accused had already been granted bail and that no witnesses had yet been examined against Saroj. Consequently, the Court denied regular bail to Sunil Kumar Tiwari but granted bail to Saroj Kumar Ojha on a Rs.10,000 bond with two sureties and conditions of personal appearance in court.

Issues considered

  • Whether bail should be granted to Sunil Kumar Tiwari given the specific allegation of firing and resulting death.
  • Whether bail should be granted to Saroj Kumar Ojha in the absence of a direct firing allegation and pending witness examination.

indiscriminately due to which he fell down and lastly

          succumbed to his injury.

                          4. It is submitted by learned counsel for the

petitioners that both the parties to the litigation are related to

each other and there is admitted land dispute between them. It is

further submitted that there is counter case filed by the co-

accused. The occurrence is said to have taken place on

30.10.2024 and the inquest report was prepared on the same day,

while the F.I.R. was registered on 01.11.2024. Further, as far as

the petitioner, Saroj Kumar Ojha is concerned, there is no

allegation of firing upon him, rather the allegation remains

confined to the fact that he was also armed and had threatened.

whom the allegation was of threatening have already been
