Patna High Court

Sarita DeviversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner with specified conditions.

Summary

Sarita Devi, the mother‑in‑law of a deceased woman, was implicated in a dowry‑death case (PS‑Adapur Case No.281 of 2025) under Sections 80, 61(2), 3(5) of the Bihar Narcotic Substances Act, 2023 and Sections 3/4 of the Dowry Prohibition Act. She applied for anticipatory bail, claiming a clean antecedent and arguing that the FIR contains only a generic, omnibus allegation against all accused without specific reference to any assault or dowry demand by her. The State opposed the bail, but the court noted that a co‑accused (her husband) had already been granted regular bail and that no particular incriminating act was attributed to her. Considering these factors, the court granted anticipatory bail subject to a Rs.10,000 bond, two sureties, and conditions under Section 438(2) of the CrPC and Section 482(2) of the BNSS, 2023. The order also imposed compliance requirements such as cooperation in trial, presence in court, and prohibition against tampering with evidence or witnesses.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner given the nature of the allegations and her clean antecedent.
