Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner subject to bond, sureties, a charitable donation, and regular police‑station attendance.

Summary

The petitioner, Ranjan Singh, was arrested in connection with the recovery of 7.380 litres of illicit liquor and charged under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act. He claimed innocence, stating that nothing was found in his conscious possession and that he had been in custody since 30 May 2026. The petitioner offered to donate Rs.20,000 to a charitable organization without admitting guilt. The State opposed bail, but the Court, after considering the circumstances, granted bail on a bond of Rs.10,000 with two sureties, conditioned on the donation, regular attendance at the police station on specified Sundays, and the possibility of cancellation for non‑appearance. The order was limited to the bail application and did not prejudice the merits of the trial.

Issues considered

  • Whether bail should be granted to the petitioner accused under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act
